1.Acceptance of these terms

By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind it. If you do not agree, do not use the Service.

2.What the Service provides

Aurmetric publishes a labor-market benchmark — the “Actual Rate” — together with dashboards, an API, reports, and related analysis. The Service combines publicly available government data with the Company’s own methodology and estimates to produce measures of labor underutilization by geography and, where offered, industry.

3.Nature of the data — estimates, not official statistics

This is the most important section. The Service presents a mix of measured and modeled figures, labeled throughout as Live (real public data), Modeled (our estimation engine), and Illustrative (demonstration). You agree to read and rely on these labels.

4.Data sources & attribution

Underlying public data is sourced from U.S. federal government programs, including the BLS (Local Area Unemployment Statistics; Current Population Survey; alternative measures of labor underutilization) and the U.S. Census Bureau. Works of the U.S. federal government are generally not subject to copyright and are in the public domain.

5.No warranty

THE SERVICE AND ALL DATA, ESTIMATES, AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, and non-infringement. The Company does not warrant that the estimates are accurate or that the Service will be uninterrupted or error-free.

6.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE OR ITS ESTIMATES. The Company’s total aggregate liability will not exceed the greater of US $100 or the fees you paid to the Company in the 12 months before the claim.

You are solely responsible for decisions (including hiring, wage, investment, relocation, or policy decisions) you make based on the Service.

8.Intellectual property

The Company owns the Service’s methodology, software, models, aggregated and derived datasets, dashboards, brand, and content, except for underlying public-domain government data. Subject to these Terms and your plan, the Company grants you a limited, non-exclusive, non-transferable license to use the Service and its outputs for your internal business purposes. All rights not expressly granted are reserved.

9.Survey data, informal-economy estimates & privacy

Some estimates draw on the Company’s own anonymous, aggregate research (including randomized-response surveys) designed so that no individual response is identifiable and no personally identifiable information or immigration status is collected or linked to any person. This research is conducted under applicable ethics/human-subjects review and privacy law.

Attorney review required. The survey and informal-labor program raises human-subjects, privacy, and jurisdictional issues. This program, and any related privacy policy, must be reviewed and approved by qualified counsel and an ethics/IRB process before deployment.

The Company’s handling of your account and usage data is described in our Privacy Policy.

10.Not financial, employment, or legal advice

The Service is for informational purposes only and does not constitute financial, investment, employment, legal, immigration, or economic advice. Consult qualified professionals before acting on any figure.

11.Subscriptions & billing

Paid plans (e.g., Pro, API, Enterprise) are billed as described at checkout. Fees are non-refundable except as required by law. Plans renew monthly until cancelled. The Company may change pricing prospectively with 30 days’ notice. Taxes are your responsibility where applicable.

12.Changes, governing law & contact

Changes. We may update these Terms; material changes will be posted with a new “Last updated” date and, where required, notified to you. Continued use constitutes acceptance.

Governing law & disputes. These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state and federal courts located in California.
